These Terms and Conditions, including all documents referenced herein, represent the entire understanding between ProCaps and you regarding your use of this Site and supersede any prior statements or representations. The Site’s Privacy Policy is incorporated into these Terms and Conditions by reference and is made a part hereof.

The information on this Site is for informational purposes only and is not intended as a substitute for advice from your physician or other healthcare professional or any information contained on or in any product label or packaging. You should not use the information on this site for diagnosis or treatment of any health problem or for prescription of any medication or other treatment. ProCaps may terminate your right to access and/or use the Site at any time and for any reason whatsoever. ProCaps shall not be liable to you for any termination of the Terms and Conditions, including information that may have been saved to any account you may have set up.

What Information We Collect About You and How We Collect It

The Personal Information We Collect. This Privacy Policy applies to all information collected by or submitted to the Website. We consider “Personal Information” to mean information about an identifiable individual. If you subscribe to our newsletter, set up an account, use our online chat function to chat with us via the Site, purchase products via the Site, or participate in activities or promotions that may be offered on the Site from time to time, you will be asked to provide a variety of information including, but not limited to, your name, password preference, mailing address, email address, phone number, and other similar information about you.

This Site does not collect your financial information. However, when you shop and purchase our Products on the Site, you will be redirected to a website hosted by a third party that is not owned or controlled by ProCaps. Purchases or sales made on or from that Site are not governed by the Privacy Policy and/or Terms and Conditions of this Site. An IP (Internet Protocol) address is a number that is automatically assigned to your computer by your internet service provider when you log on. Your IP address is not linked to your Personal Information but ProCaps does reserve the right to use IP addresses to identify individuals who threaten the Website or other users or visitors. IP addresses may also be used to help diagnose problems with the Website and to gather broad demographic information.

Third-Party Applications. Some Users or visitors may connect with the Website using Facebook or Instagram. If you decide to connect to the Site through an external, third-party application, you will be granting ProCaps permission to receive information from such third-party applications.

Other Information. When you access the Website, ProCaps will automatically receive some information about your use of the Website. The type of information that is automatically collected by ProCaps includes such things as the date and time of access of the Website, the Internet protocol (IP) address of the computer that you are using, the domain and host from which you access the Internet, your browser software and operating system, the referring website address, and the kinds of activities you are engaging in on the Website. This information is used to help us improve and enhance the Website to better meet the needs of its users.

ProCaps contracts with non-affiliated third parties/business partners to host the Website and to provide data collection and reports regarding Visitors’ activities on the Website. On our behalf, these non-affiliated third parties/business partners use cookies to receive and collect information anonymously (meaning without attaching it to any personally identifiable user) about Visitors’ activities and collect and aggregate such information as collected from many Users of the Website. These non-affiliated third parties/business partners have agreed not to use this information other than (i) in connection with providing services to us to make our Website more useful and efficient, (ii) as permitted in this Privacy Policy, or (iii) as otherwise permitted by law.

ProCaps will also aggregate anonymized Personal Information and may use, share and disclose such aggregated information as permitted by law. For example, we may use such information for research and product development purposes, and may also share such aggregated information with ProCaps business partners.

Regardless of whether a User has chosen to limit ProCaps’ sharing of Personal Information as collected on the Website, ProCaps may, without restriction, use, share and disclose aggregated statistics about Users, along with specific information concerning individual Users that is not Personal Information in any way permitted by applicable law.

Use of Cookies and Web Beacons; Use of Google Analytics

The Website may make use of: (i) “cookies” – small data files which we may send to your computer on the basis of the information that we have collected about your visit; and (ii) “web beacons” – small strings of code that provide a graphic image that surveys visitors’ internet activity. In the event that ProCaps, or an affiliate of ProCaps is involved in a merger, acquisition, consolidation, restructuring, reorganization, liquidation, sale or similar transaction relating to any portion of its business and/or assets, or in the unlikely event that ProCaps goes out of business or enters bankruptcy, each User hereby acknowledges and agrees that the Website, all data collected on the Website (including Personal Information still within our possession, custody or control), and any of our rights and obligations under this Privacy Policy may be included in the assets of, and/or transferred pursuant to, such transaction, and that any acquirer or successor (or a third party through bankruptcy) of ProCaps may continue to use the Personal Information as set forth in this Privacy Policy. Retention of Personal Information

Personal Information is retained to deliver our services, to otherwise fulfill identified or apparent purposes, and Personal Information may be retained for record-keeping, and for the following purposes:

● Your Personal Information is reasonably necessary to manage our operations, to manage your relationship with us, or to satisfy another purpose for which we collected the information;

● Your Personal Information is reasonably necessary to carry out a disclosed purpose that is reasonably compatible with the context in which the personal information was collected;

At some point ProCaps may elect to destroy, erase or anonymize your Personal Information.

Children’s Privacy

We do not knowingly collect Personal Information from children under the age of 13. If you believe we have collect Personal Information from a minor, please contact us via the information in the Contact Us section below and we will take appropriate steps to delete it.

Opting In and Opting Out of Electronic Communications

At certain points where Personal Information is collected on our Website, there may be a box to indicate that you wish to receive certain information or communications from us. You may opt out of receiving electronic communications, such as emails from us at any time. In all of our electronic communications you will be given the opportunity to opt out of receiving future communications.

Do Not Track Signals

Certain web browsers provide users with an option by which you may have your browser send a “Do Not Track” signal to websites that you are visiting, advising the recipient websites that you do not want to have your online activity tracked. However, the way browsers communicate such “Do Not Track” signals is not yet uniform and, accordingly, our Website does not take any action in response to such signals. In the event a final standard is developed and accepted, we may reassess how we should respond to such signals.

Personal Information will be stored in databases and servers located in the United States. Based on your request, we will investigate to determine if we have any of your Personal Information. If we do have your Personal Information (other than that provided in your request), we will seek to verify your identity based on the Personal Information that we already have; the data we will request will depend on the nature of the Personal Information we have about you. Once we verify your identity, we will provide you with a response, indicating how we will satisfy your request or why we cannot comply with your request.

For all requests, we will provide a response within 45 days, and let you know if longer is needed. If we do not take any action on the request, we will let you know why, and it is usually because we cannot verify your identity or we have verified your identity but identified that you are not and have not been a California or Colorado resident in the relevant time period.

For Colorado residents, you can appeal this decision/non-action. You may also contact the Colorado Attorney General if you have concerns about the result of the appeal.

Over the past 12 months, we have not sold or shared your Personal Information as those terms are defined by the CCPA and/or CPA.
